What is a wrongful death claim?

A: Wrongful death is a special claim, and the Texas Legislature has set limits on who can bring a wrongful death lawsuit.  Only the deceased’s parents, surviving spouse, or children are able to recover in a wrongful death lawsuit.  Other relatives, such as grandparents and siblings, may not recover for a wrongful death.  In a wrongful death case, the defendant—if found liable for the death—is also liable to the parents, serving spouse, and children for their loss.
