WACO (May 10, 2011)-Robert David Cole, 20, a Baylor University student who's charged with sexual assault in an alleged date rape during a drunken campus-area party was free on $25,000 bond Tuesday after turning himself in.

An arrest warrant was issued last Wednesday and Cole turned himself in on Monday, police said.

The charge stems from an incident that happened in January at a party in a campus-area residence in the 1200 block of Wood Avenue.

According to the affidavit submitted for the arrest warrant, Cole and the victim went to the party where both "consumed a large amount of alcohol."

The victim became so intoxicated that "she was stumbling around and was embarrassing herself," the affidavit said, so a friend took her into a bedroom so she could lie down.

She was at the point of passing out when Cole got into the bed with her and then ejaculated into her mouth, the affidavit said.

The affidavit said the victim wasn't aware at the time of what had happened, but says Cole told her the next day what he had done.
