A Fort Campbell soldier who allegedly raped another soldier in his company can get out of jail whenever a superior officer comes to pick him up, a judge ruled last week. But eight days after the judge’s ruling, the soldier still waits behind bars.

 

Deltwon Ferguson, 21, who lived in Texas before moving to Fort Campbell’s barracks, was indicted in November on a first-degree rape charge. The indictment remained sealed until Oak Grove police arrested Ferguson on Feb. 11.

 

The indictment indicates that Ferguson raped a woman in July 2009, “while she was physically helpless.” Attorneys confirmed in court Wednesday that the victim belonged to Ferguson’s company. The Army later moved him to a different company, but not because of the rape accusation, said Brian Hill, the Clarksville, Tenn., attorney defending Ferguson.

 

Ferguson and the victim have each been deployed since the incident, Assistant Commonwealth’s Attorney Kathi Adams said in court.

 

Three days after Ferguson’s arrest, Hill asked to have him released to his commanding officer. The unit would give Ferguson a room in the barracks and restrict him from leaving post, Hill wrote in his motion.

 

Christian Circuit Judge Andrew Self granted the motion on Feb. 16. But because no one has come for Ferguson, Hill requested Wednesday to have him released without an officer’s help, Adams protested.

 

“It sounds like they don’t want to vouch for him,” she said of Ferguson’s unit.

 

“I don’t care if they vouch for him, as long as they control him,” Self replied.

 

Both attorneys agreed to check with Ferguson’s unit and discuss the case again on March 2.
