Gavel and JudgeNoteboom – The Law Firm assisted client in winning a net award of $349,015 (after attorney’s fees and litigation expenses were subtracted) in a case involving the attack of a vicious dog. We are proud of the results achieved on behalf of our client and are happy that she received the justice she deserved. As a result of the case, Brian Butcher was named a Texas Lawyer “litigator of the week” on March 17th, 2016.

While dogs are perhaps America’s most beloved pet, the fact of the manner is that owners are required to ensure that their animals pose no danger to others. If a dog bites and injures someone then the owner will typically be held responsible. In the instant case the defendants were shown to have trained their dog to be vicious. The animal was also shown to have been regularly escaping from the defendant’s private area. Evidence was also presented which showed that the dog had bitten numerous visitors to the owner’s household, as well as another neighbor, and that the defendant had trained the animal for bar fights. Our firm successfully argued that the animal was a terror to the neighborhood and that people had to build privacy fences just to keep it away from their pets.

Many people think of dog bites as a simple matter involving minor injuries. Dogs, however, can be dangerous animals capable of inflicting serious injuries. In this case our client was bitten on the calf. She had several deep puncture wounds which required an emergency room visit and numerous appointments with a vascular surgeon. This an example of the type of damage which can be done in such matters.
